Eltham Digital provides website design, development, digital marketing, and related services.

All work is agreed in writing (email, proposal, or contract) before commencement.

3. Quotes and pricing

• All quotes are valid for 14 days unless stated otherwise
• Pricing may vary depending on scope changes
• Any additional work outside the agreed scope may incur extra charges

4. Payment terms

• Invoices are payable within 7 days unless otherwise agreed
• Late payments may incur a $25 late fee
• Ongoing services (such as hosting, support, or marketing) are billed monthly in advance

If invoices remain unpaid and there is no communication, services may be paused or cancelled.

5. Subscription services

For subscription-based website packages:

• Minimum term is 12 months
• After the initial term, services continue month to month
• If cancelled after 12 months, the website is not transferred to the client
• If cancelled before 12 months, the remaining balance equivalent to the full build cost may be payable

6. Cancellations

• Services can be cancelled after the minimum term with written notice
• If cancelled early, fees may apply as outlined above
• If services are cancelled due to non-payment, the client may be liable for outstanding balances

7. Refunds

• If we are unable to deliver a design you are happy with before development begins, a refund may be issued
• Once development has started, refunds are not provided
• Any refunds are at our discretion

8. Client responsibilities

Clients agree to:

• Provide content, images, and feedback in a timely manner
• Review and approve work promptly
• Ensure they have rights to any content supplied

Delays in providing content may affect timelines.

9. Intellectual property

• The website and related assets remain the property of Eltham Digital under subscription arrangements
• Clients retain ownership of their domain name and any content they provide
• Under lump sum projects, ownership transfers upon full payment

10. Limitation of liability

We are not liable for:

• Loss of revenue, profits, or business opportunities
• Website downtime caused by third party services
• Issues arising from client-provided content or third party platforms

All services are provided in good faith but without guarantees of specific results.

11. Third party services

We may use third party tools and platforms (such as hosting providers, Google, Facebook, and so on).

We are not responsible for outages, changes, or issues caused by these services.

12. Website use

You agree not to:

• Use this website for unlawful purposes
• Attempt to interfere with or disrupt the site
• Copy or reuse content without permission
